Terms of Service

1. Agreement to Terms

Paint Your Photo is operated by Paintable Pictures LLC, an Ohio limited liability company located at 1747 Olentangy River Rd #1453, Columbus, OH 43212, United States. By accessing or using Paint Your Photo at magic.paintablepictures.com, including by choosing a photo, you agree to these Terms of Service. If you do not agree, do not use the service.

2. The Service

Paint Your Photo lets eligible product holders upload a photo, create a personalized paint-by-number design, preview the result, and send available files by email. These Terms govern the digital service. A retailer or other seller may have separate terms for the physical product through which you received access.

3. Access Codes

Paintable Pictures may, at its discretion, require an access code to use the service. If a code is required, it should be printed in your physical kit. You may not guess, resell, publish, or misuse a code. We may reject or disable a code associated with fraud or abuse.

4. Eligibility

You must be at least 13 to use the service. If you are under the age of majority where you live, a parent or guardian must review and agree to these Terms and supervise your use.

5. Your Photos and Other Content

When you submit a photo or other content, you represent that:

You own it or have the rights and permission needed to submit it and authorize our use
Our use of it to provide the service will not violate another person's copyright, privacy, publicity, trademark, or other rights
It does not violate law or contain fraudulent, harmful, exploitative, or obscene material
It does not sexualize or exploit a minor or a person who could reasonably appear to be a minor

You retain ownership of your original photo. You grant us a non-exclusive, worldwide, royalty-free license to host, copy, transmit, process, edit, store, and create design files from your content as needed to operate, deliver, secure, and support the service and comply with law. This license does not give us ownership of your photo.

6. Generated Designs

Subject to these Terms, you may download, print, paint, and use the generated files for personal, non-commercial purposes. You may not sell, license, publish, distribute, or use the files commercially without our written permission.

Generated designs are interpretations of the photo. Colors, details, crop, and likeness may differ from the original, and results may vary between attempts. A preview or generated file does not guarantee a particular artistic result.

7. Automated Processing and Service Providers

The service uses automated image-processing technologies. We may use service providers to host, process, store, secure, and deliver photos and design files on our behalf. Our Privacy Policy explains how uploaded images and personal information are handled.

8. Review, Refusal, and Availability

Uploading a photo or receiving a preview does not guarantee that processing or delivery will be completed. We may review, refuse, remove, suspend, or decline to process content or access that we believe creates legal, safety, security, operational, or business risk or violates these Terms.

The service may be changed, interrupted, limited, or discontinued. Processing and email delivery times are estimates and are not guaranteed.

9. Email and Support

You are responsible for providing an accurate email address and protecting links sent to you. Design links may allow anyone who has the link to view or download the related files. Contact [email protected] if you need help.

10. Acceptable Use

You may not:

Use bots, scrapers, or automated tools to access the service without our written permission
Probe, disrupt, overload, or bypass the service or its security controls
Upload malware or content that violates these Terms or another person's rights
Use the service or its outputs for an unlawful purpose
Misrepresent an affiliation with Paintable Pictures LLC

11. Our Intellectual Property

The service, including its software, processing methods, website, text, graphics, and branding, is owned by Paintable Pictures LLC or its licensors and is protected by law. These Terms do not grant rights in the service except the limited right to use it as described here.

12. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND GENERATED FILES ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

13. Limitation of Liability

To the maximum extent permitted by law, Paintable Pictures LLC and its officers, employees, agents, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the service. Our total liability for a claim will not exceed the amount paid for the specific product or service giving rise to the claim.

Some laws do not allow certain exclusions or limits. In those places, these provisions apply only to the extent permitted and do not affect rights that cannot be waived.

14. Indemnification

You agree to indemnify and hold harmless Paintable Pictures LLC, its officers, employees, and agents from claims, losses, liabilities, and reasonable legal fees arising from your content, your misuse of the service, or your violation of these Terms or another person's rights.

15. Governing Law and Disputes

These Terms are governed by Ohio law, without regard to conflict-of-law rules. Before filing a legal claim, you agree to contact [email protected] and try to resolve the dispute informally for 30 days.

If the dispute is not resolved, legal proceedings must be brought in the state or federal courts located in Franklin County, Ohio, unless applicable consumer law requires otherwise.

16. General Terms

Severability: If a provision is unenforceable, the remaining provisions continue in effect.
Waiver: A failure to enforce a provision is not a waiver of it.
Assignment: You may not transfer these Terms without our consent. We may transfer them as part of a merger, reorganization, sale, or transfer of the service.
Entire agreement: These Terms and our Privacy Policy are the entire agreement concerning the Paint Your Photo service.

17. Changes to These Terms

We may update these Terms. We will post the new version here and change the date at the top. Changes apply prospectively unless law requires otherwise. Using the service after the updated Terms take effect means you accept them.
